Primary Duty of Care
Every PCBU must ensure, so far as is reasonably practicable, the psychological health and safety of workers — not just physical safety. Health explicitly includes psychological health.

Specific Psychosocial Duties
Businesses must identify hazards, assess risks, implement controls, and review them. Four separate, enforceable obligations — each requiring documentation.

Officer Due Diligence
Directors and senior executives have a personal, non-delegable duty to verify compliance. Officers are personally liable if they can't demonstrate active knowledge.
Penalties for failing to comply range from $570,000 for Category 3 offences to $3.5 million for a body corporate for Category 1. WorkSafe WA can issue improvement and prohibition notices — based on the absence of systems, not just the occurrence of harm.
